Woman Sell Husband House After Sleeping With Her Lovers There
A man, Olatomiwa, has approached Grade A Customary Court, Mapo, Ibadan, seeking an end to his 10-year-old wedlock to his wife, Sabina, whom he stated refused that he had rest of mind because she was in the habit of fighting him and his first wife.
Olatomiwa also said that Sabina was cruel and violent and always fought him with dangerous objects, which made him abandon his home.
According to the plaintiff, the defendant brought her lovers to his house and made love with them there, adding that she later threatened to sell the same house when he challenged her.
Olatomiwa told the court he could no longer tolerate his wifeโs atrocities and therefore prayed that their union be dissolved.
The plaintiff further pleaded for their childrenโs custody, expressing the fear that the defendant could take them out of his reach or deny him access to them.
Olatomiwa said in his evidence, โI met my wife in 2015.
โShe is from Cotonou, but resides in Nigeria.
โAfter dating for a few months, we decided to get married, and I went to Cotonou with some relatives and friends to carry out the marital rites.
โThe bride price her family collected from me was N60,000 if converted to Nigerian currency.
โI established her in a soap business after we got married, and she was doing well.
โOur relationship was intimate. We were always in each otherโs company and had lovely moments.
โShe later informed me she wanted to start selling palm wine and I gave her a go-ahead.
โMy wife, to my chagrin, changed; immediately she started this business.
โShe became troublesome and uncontrollable.
โSabina started flouting my orders and turned our home upside down.
โShe took to fighting me at every given opportunity and refused that I had peace of mind.
โSabina became cruel and violent and would attack me with any dangerous object within her reach.
โShe extended the hostile behaviour also to my first wife and her children.
โOur home became disorderly.
โI moved out of the house when I could no longer tolerate her excesses, and she turned our home into a brothel.
โMy wife started bringing home her lovers. I was mad when informed of this, and I challenged her.
โMy lord, my wife has no shame. Rather than being remorseful, she dared me to do my worst.
โSabina further threatened to sell my house, which was my reason for coming to court.
โMy lord, I can no longer live under the same roof with a slut.
โA promiscuous woman can kill, and I am not ready to die now.
โMy lord, I pray this honourable court to end our relationship.
โI also entreat the court to grant me custody of our children.
โI will put them in my motherโs care.
โMy lord, if Sabina has custody of our children, she would take them to Cotonou out of my reach and would deny me access to them.โ
The court president. Mrs S.M Akintayo, in her judgment, stated that the couple had a subsisting customary marriage since the defendantโs bride price was paid.
According to her, the court had no option but to dissolve their wedlock since he stated that he could no longer tolerate his wifeโs indecent lifestyle.
Ruling, Akintayo pronounced their wedlock dissolved.
She granted the defendant custody of their children, stating that they were still young and in their tender age.
She granted the defendant access to their children and also made him responsible for their childrenโs upkeep, giving feeding, education, and healthcare a priority.
